New law clarifies alcohol service in licensed assisted living facilities

During the 2026 legislative session, a bill commonly referred to as the “Senior Happy Hour” bill brought attention to the ability of assisted living facilities (ALFs) to provide alcoholic beverages during resident activities, meals, and special events.

The new law provides clarification for licensed ALFs that want to support resident choice and social engagement while ensuring alcohol service is provided within appropriate legal and operational boundaries.

The most important consideration for providers is whether alcohol is being provided as part of a resident activity or being sold as a commercial service.

Under statutory exemption, a licensed ALF may serve alcoholic beverages without a liquor license when specific requirements are met, including:
  • Alcohol is served only on facility property
  • Alcohol is provided only to residents and their accompanied guests who are 21 years of age or older
  • Alcohol is served during resident activities or events
  • Alcohol is not sold, charged for, or provided as a revenue-generating service

A liquor license is still required when a facility sells alcohol, charges residents or guests for alcoholic beverages, operates a cash bar, or provides alcohol as a commercial service.

While the law provides additional flexibility, ALFs should continue to approach alcohol service thoughtfully. Providers should review policies and practices related to:
  • Resident choice, preferences, and informed decision-making
  • Individual risks, including medication interactions and cognitive considerations
  • Safe storage and access to alcohol
  • Staff responsibilities, including recognizing intoxication and refusing service when appropriate
  • Age requirements and restrictions related to serving alcohol. 
ALFs operating under statutory exemption must also complete the required notification process with the Minnesota Department of Public Safety:

Care Providers of Minnesota has developed a practical guide, “Serving Alcohol in Licensed Assisted Living Facilities (ALFs): A Practical Guide to Determining When a Liquor License Is Required” to help providers understand when a liquor license is required, how the exemption applies, and operational considerations for serving alcohol in assisted living settings.

As assisted living continues to focus on resident-centered care, this change provides an opportunity for ALFs to support meaningful activities and resident choice while maintaining appropriate safeguards.
