Recap from moratorium exception town hall

On Monday, November 20, 2023, the chairs of the House and Senate Human Services Committees, Chair Noor and Chair Hoffman, held a townhall for small assisted living providers to discuss the optional transition to community residential setting (CRS) for eligible customized living services (CLS) providers who are currently operating in an assisted living facility setting. 

There were several staff from the Department of Human Services (DHS) and some Hennepin County staff present to answer questions.  

This is a time-limited moratorium exception, and it ends in December 2023. There is currently a backlog of applications and DHS is on pace to receive over 1200 applications by the end of the year. However, DHS stated that if your application is in by the end of the year, it will still be processed.  

Some key takeaways DHS and Hennepin County mentioned last night were as follows: 
  • CRS is client based, not facility or bed based
    • The individual receiving services needs to decide if they want to transition to CRS from AL—this conversation must take place between the case manager and the individual, not the provider and the individual
  • Rates for CRS are staff based and less complicated than customized living
  • There are more opportunities to provide remote services under CRS
  • Newly licensed assisted living facilities are not eligible for the moratorium exception to transition to CRS
  • Once an assisted living facility transitions to CRS, they may not simply go back to their assisted living license, they must reapply and adhere to all current assisted living requirements
